Department of Defense (DOD)
Local governments must report to DOD when they receive a project application (RCW 36.01.320). We recommend developers consult with DOD early in the siting process to identify and avoid risks that may be associated with military operations and safety. Environmental Protection Agency (EPA)
EPA maintains and enforces national standards under a variety of environmental laws in consultation with state, tribal, and local governments. It delegates some permitting, monitoring, and enforcement to states and federally recognized tribes. We administer permits issued under section 401 of the Clean Water Act with input from the Washington Department of Ecology. EPA review is required if projects involve lands listed as Superfund cleanup sites.

State Agencies:
Department of Agriculture (AGR)
Washington State has laws to protect and preserve its limited agricultural areas. RCW 89.10.005 recognizes this need. RCW 36.70A, commonly known as the Growth Management Act, requires local governments to plan for and adopt local policies and regulations to preserve local resources, including lands of prime or unique soils and “soils of long-term commercial significance”. We work with AGR to identify impacts on agricultural soils, identify mitigation measures, or recommend avoidance.

Department of Archaeology and Historic Preservation (DAHP)
DAHP employees are subject matter experts on historical and cultural issues. Plans, permits, and consultations are required prior to conducting initial field surveys. DAHP can provide guidance about engaging with Tribal Nations located in or with rights within Washington state.

Department of Ecology (ECY)
ECY is responsible for recommending site specific studies for wetland delineations, stormwater runoff, water consumption, and discharges. Their Water Quality Certification program requires applicants to apply for Section 401 Water Quality Certification permits. We issue Section 401 permits with ECY’s input.

Department of Fish and Wildlife (DFW)
WDFW conducts habitat mapping, vegetation, and wildlife surveys. They determine when seasonal field studies should occur. WDFW has expertise in identifying impacts and developing mitigations to either avoid or minimize project impacts. We strongly suggest early consultation due to the seasonal nature of required surveys.

Department of Health (DOH)
DOH is required to review applications for nuclear fusion and nuclear fission energy. Other energy types do not require DOH consultation.

Department of Natural Resources (DNR)
DNR accepts, reviews, and issues access permits and land-use leases for use of public lands and state-owned aquatic lands. Public lands include state-owned tidelands and, in some instances, riverbeds. We're not involved with this process. Any project involving public lands must apply directly to DNR for a lease permit. We strongly recommend early contact with DNR as their review process does not correspond with ours.

Department of Transportation (WSDOT)
Projects often involve access from state highways. WSDOT also reviews railroad crossings and access improvements. We recommend coordination with WSDOT during the pre-application phase to identify necessary road improvements and required permits.
