In July 2024, we made a proposal to use the expedited rulemaking process to change Title 463 Washington Administrative Code (WAC), the main state rules our agency follows and enforces, to bring them into line with existing statute and practice. Due to objections raised, we converted the expedited rulemaking notice into a preproposal statement of inquiry (CR-101) as the formal start of regular rulemaking (see housekeeping rulemaking effective June 23, 2025).
About this rule
We became an independent agency on June 30, 2022, when E2SHB 1812 went into effect. The bill modernized our agency to meet the state’s clean energy goals.
The 2022 law changed the energy facilities—site locations (Chapter 80.50 RCW), requiring us to update parts of Energy Facility Site Evaluation Council (Title 463 WAC) to align our agency rules with the new state law.
