Permit development
Summary
Certain permits governing energy facilities need to be updated on a regular basis or when changes are made to the facility's operating systems.
Our state regulations provide details about the permitting of facilities to comply with the terms of a site certification agreement. For regulatory details, please see Chapter 463-76 WAC and Chapter 463-78 WAC.
From September to November 2025, we processed renewal permits for the project’s Air Operating Permit (AOP) and National Pollutant Discharge Elimination System (NPDES) as required by our regulations. The council approved the NPDES at their November 2025 meeting. The AOP is subject to a 45-day review by the U.S. Environmental Protection Agency (EPA) prior to a Council vote.
Description
We held a public comment period for the facility’s renewal of their AOP, along with the addition of an Acid Rain permit. The comment period was held from October 6 to November 5, 2025, and received three comments, all of which were in opposition to the renewal. The AOP is subject to a 45-day review by the Environmental Protection Agency prior to being approved by the Council.
We held a public comment period for the facility’s renewal of their NPDES permit. The comment period was held from September 29 to October 28, 2025, and received no comments. The Council approved the NPDES permit at the November 2025 Council meeting.
Prior permitting action included, Council approval and issuance of a five-year Title V Air Operating Permit effective July 17, 2024 and issuance of a fifth amendment to the Prevention of Significant Deterioration (PSD) permit on January 28, 2021.
