Permit development
Summary
State law requires us to update energy facility permits regularly or whenever a facility changes its operations. These updates keep the project in line with the state’s current health and safety standards.
State rules establish the requirements for energy facilities to meet the terms of their site certification agreements. For the specific rules for these permits, please see chapters 463-76 and 463-78 WAC.
The Council updated several permits for the facility between late 2025 and early 2026. These updates included renewals for the Title V air operating permit (AOP), national pollutant discharge elimination system (NPDES) permit, and the acid rain permit.
Description
On November 19, 2025, the Council voted unanimously to approve the NPDES permit for the facility. We received no comments during a 30-day comment period that ended on October 28, 2025.
On February 18, 2026, the Council voted unanimously to approve the Title V AOP, No. EFSEC/25-01-AOP, which includes the acid rain permit. We held a comment period for both permits from October 6 to November 5, 2025, and received three comments, all of which were in opposition to the renewal. The approved permits took effect on March 5, 2026, and will expire on March 5, 2031.
