After the governor has signed a Site Certification Agreement (SCA), we continue to regulate and oversee an energy facility to ensure it complies with state laws and rules.

About this milestone

The goal of our ongoing oversight is to:

  • Monitor the effects of building and operating a facility
  • Ensure that the certificate holder complies with the requirements of their SCA and permits

If the facility isn’t compliant, we can issue fines or take other actions.

Facility inspections

Other state agencies and contractors may perform on-site inspections on our behalf.

Involvement of federal agencies

Federal agencies may also oversee the facility. If so, we’ll work with them to ensure we aren’t duplicating their work.

Our oversight lasts until the certificate holder decommissions the facility and completes site restoration.

Completing this milestone

Milestone requirements
  1. The governor and applicant execute the SCA.
  2. The certificate holder applies for and renews permits as needed.
  3. We’ll monitor the facility according to the thresholds identified in the permits.
  4. The certificate holder will report to us as the permit or SCA describes.
  5. The certificate holder will report any deviations from the conditions of the permit or SCA. If appropriate, we’ll take action to enforce the conditions.
